Here is an example to help you better understand how it works.
Let us suppose that Ali and Nadia married. They had three
children together, two sons and one daughter. Nadia also has two
sisters and a brother. Nadia passes away, survived by her two parents,
Hamza and Hana. She chose not to have a wasiyyah. According to the
Sharia law on property distribution:
- Ali (the husband) will receive ¼ of her property in the presence of children or 1/2 when there is no child.
- Hamza and Hana (the parents) will receive ⅙ each.
- The two sons will receive ⅙ each.
- The daughter will receive 1/12.
- Nadia’s sisters and brother receive nothing.
So, a husband is entitled to half his deceased wife’s estate if she has no children.
If she has children, he is entitled to a quarter share as mentioned above.
